IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 928 WRIT PETITION NO. 1740 OF 2016 NAMRATA PRABHAKAR RAUT

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. Salgare Vitthal G. AGP for Respondents/State : Mr. P.S. Patil Advocate for Respondents : Mr. Sachin K. h/f. V.D. Salunke ...

CORAM : S.V. GANGAPURWALA & MANGESH S. PATIL, JJ.

DATE :

12.09.2017 P.C. :- .

The order transferring the petitioner from Nanded to Umardari is challenged. The petitioner was working as a 'Junior Lecturer' at Nanded Shivaji Junior College run by the respondent no.4. In July 2015, the petitioner was transferred to Umardari Narsinha Secondary and Higher Secondary School run by the same institution. 2.

According to Mr. Salgare, the learned counsel, the petitioner is a widow. Even the petitioner has made representation to the respondent no.4 as well as to respondent nos. 2 and 3, but the same is not considered.

( 2 ) 928 wp 1740.16 3.

We have heard the learned counsel for the respondent no.4 and the learned A.G.P.

4.

It appears that the petitioner has already joined on 15.07.2015 at Umardari and more than two years have lapsed. It would not be appropriate to consider the said order of transfer on merits now. 5.

Mr. Salgare, the learned counsel submits that the petitioner would file a fresh representation with respondent no.4 for transferring her back at Nanded.

6.

In case such a representation is filed, the respondent no.4 shall consider the said representation on its own merits, expeditiously and preferably within two months from the date of representation. Writ petition accordingly disposed of. No costs. [MANGESH S. PATIL, J.] [S.V. GANGAPURWALA, J.] mub
