PER COURT :- None for the petitioner and respondents 2 to 4. Learned AGP appears for the State and Honourable Chancellor of the University. The petitioner was appointed as a Professor on probation for two years and was terminated during the period of probation The petitioner has challenged the letter issued by the Registrar of the University dated 1.12.1998, terminating his services as a Professor in Inorganic Chemistry. By the said communication, the petitioner was relived from his charge as Professor in Inorganic Chemistry following his termination and he was permitted to join as a Reader in the Department of Chemistry.

2- WRIT PETITION NO. 4345 OF 1998 & ANR The learned Division Bench of this Court issued notice on 5.10.1998. By order dated 7.12.1998, interim relief was refused to the petitioner and the charge of the post of Head of Department that was handed over to respondent No.4 was made subject to the result of the pending representation of the petitioner. By order dated 27.7.1999, this petition was admitted and interim relief was refused. The petitioner was 56 years of age in 1998. He would be 76 years of age after a passage of 20 years, today.

Considering the above, I do not find that this petition needs to be entertained. The same is, therefore, disposed off for being infructuous. Rule is discharged.

Pending Civil Application does not survive and stands disposed off.

By Writ Petition No.444 of 1999 the petitioner posed a challenge to the appointment of Dr. Y.H.Deshpande, who is the petitioner in the first petition.

3- WRIT PETITION NO. 4345 OF 1998 & ANR Considering the disposal of the petition filed by Dr. Deshpande, this petition does not survive and stands disposed off. Rule is discharged.
