The learned Counsel for the petitioner states that the petitioner is cultivating Government Gairan land admeasuring 10 acres in Gut No. 116 situated at village Lahan, Taluka Ardhapur, Dist. Nanded since 1975. The name of the petitioner is not mutated in the revenue record. 2.

The learned AGP accepts notice for all respondents and submits that the name of the petitioner is mutated to the extent of encroachment regularized under the order of the Collector. 3.

The mutation entry cannot be effected in respect of the land of which order is not passed in favour of the petitioner. The petitioner may prosecute his grievance with the authorities with regard to the regularization, if it is permissible in law.

Writ Petition is disposed of. No costs.
