This appeal was admitted by an order of this Court, dated 17/03/2023 and the parties were referred to the learned Mediator Smt. Vaishali Shinde, learned Advocate. In mediation, the parties have arrived at a compromise. The learned Mediator has tendered the mediation report dated 26/06/2023, which is along with the compromise terms (11 pages). The same is collectively marked as 'X-1' for identification. 2.

The learned Advocate for the appellant/husband tenders the Demand Draft dated 23/06/2023 for an amount of Rs.7,00,000/-, drawn in the name of 'Sangita Shrimant Kadam',

29.23fca (2) the respondent/wife. The photostat copy of the same is taken on record and marked as 'X-2' for identification. The Demand Draft is handed over to the learned Advocate for the respondent/wife. 3.

Both the learned Advocates, therefore, submit that the parties have separated by a mutual consent. This appeal is, therefore, partly allowed. The impugned order is quashed and set aside. Decree be drawn accordingly.
