Heard learned Counsel for the applicant - wife. The respondent husband, though served with notice but remained absent.

The applicant - wife is seeking transfer of Regular Civil Suit No. 75 of 2017 filed by respondent - husband for restitution of conjugal rights from the Civil Judge Junior Division, Bhusawal to Civil Judge Junior Division, Nanded. 3.

According to the applicant - wife, she is not having any independent source of income and residing at Naded, which is at more than 500 Kilometers from Bhusawal. Moreover, she Pooja K.

983-MCA-27-2018 has also filed three proceedings at Nanded against the respondent - husband wherein he has already appeared. There is no oppose to the application and therefore considering the convenience of applicant - wife following order is passed :

ORDER

(i) The application is hereby allowed.

(ii) Regular Civil Suit No. 75 of 2017 pending in the Court of Civil Judge Junior Division, Bhusawal, Dist. Jalgaon is transferred to the Court of Civil Judge Junior Division, Nanded for disposal according to law.

(iii) The respondent - husband is directed to appear before the Civil Judge Junior Division, Nanded, on or before 15th July, 2023.
