Heard learned A.P.P. for the applicant/ State and learned counsel appearing for respondents No.1 and 2. 2.
We have carefully perused the findings recorded by the trial Court. Prima facie it appears that the trial Court has not properly appreciated the evidence brought on record by the prosecution. In this view of the matter, case is established for allowing this application. Accordingly, the Criminal Application is allowed in terms of prayer clauses A, D and E and stands disposed of.
