All these petitioners together have filed this single petition. Some of them possess the qualification of D.Ed./D.T.Ed.. For appearing in the Maharashtra Teachers Aptitude and Intelligence Test (TAIT) 2022, examination, they require qualification of TET. By a public notice dated 07.02.2023, issued by respondent No.2, the Maharashtra State Council for Examinations and respondent No.3, the TAIT Committee, it is clarified that those who have appeared for the CTET and results are yet to be declared, are held to be eligible for appearing in TAIT examination, since they have other qualifications of D.Ed./D.T.Ed etc. The grievance of some of these petitioners is, therefore, redressed. 2.

Insofar as the other petitioners are concerned, they are from the B.Ed. category. The law mandates that those, who have passed B.Ed. Examination, can appear for the TAIT examination. This group of petitioners are such, who are yet to appear for the final year B.Ed.

wp1513.23 -2examination. The dates of such examination are yet to be declared. They seem to be in a hurry to appear for TAIT examination, without acquiring the qualification of B.Ed., on the apprehension that the TAIT examination is held after a gap of five years and they are circumspect as to whether such examination would be held every year. 3.

By order dated 13.10.2022, this Court (Coram: Ravindra V. Ghuge and Sanjay A. Deshmukh, JJ.) in Suo Motu P.I.L. No. 2 of 2022, had directed the State Government to ensure that TAIT online examinations would be completed and the results would be declared on or before 05.03.2023. It is a view of the court that said TAIT examination has to be conducted every year. The said P.I.L. is pending before this Court.

In the above backdrop, when these petitioners are yet to even appear for the B.Ed. final year examination and the dates of the examination are still not declared, prayer to postpone the TAIT, 2022 examination cannot be entertained on this ground. 5.
