The petitioner was a Clerk with the Municipal Corporation, Latur. He has been dismissed from service on 04.12.2021 on allegations of absenteeism. As such, the petitioner can advantageously file a ULP complaint under the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 before the Labour Court at Latur.

The learned advocate for the petitioner submits that the petitioner desires to file a departmental appeal under Section 56 (4) of the Maharashtra Municipal Corporations Act, before the standing committee.
