Mr. Thombre, learned counsel for the petitioner submits that the students of the petitioner-College appearing for H.S.C. Examination were attached to the Examination Centre near to petitioner-College. The learned counsel relying on the Certificate issued by the Executive Engineer, Public Works Department, Jalna states that the distance from

2 WP 1832/17 Rammurti to J.E.S. College, Jalna would be 18 k.ms. Learned counsel further submits that the distance between Centre of petitioner-Institution at Rammurti and Ramnagar is only 10 k.ms. Till last year, the students of the petitioner-Institution were attached to Ramnagar Centre, therefore, there was no need to change the same. Learned counsel submits that the respondents are not considering the said aspect. 2.

Ms. Mahajan, learned counsel for the respondents submits that the show-cause-notice was issued to the petitioner-College. The explanation was called and thereafter the decision has been taken. The students of the petitioner-Institution are attached to Jalna, which is in the same zone and at the distance of 6 to 7 k.ms. According to the learned counsel, there is no issue of transportation. The said zone is in the region of Jalna. The students are not required to enter the City also.

The distance between Rammurti to Ramnagar Bus Stop is 10 k.ms. The distance given from Rammurti

3 WP 1832/17 village to Jalna Bus Stand to J.E.S. College Jalna is 18 k.ms. It is not clear as to whether for going to J.E.S. College Jalna one has to go to Jalna Bus Stand. Be that as it may, the petitioner-centre is attached to the colleges at Jalna. It is the urban area, where the transportation facility would be better available. The petitioner is having about 28 students appearing for the examination. The arrangements are also made at urban place.

Considering the above, Writ Petition stands disposed of. No costs.
