Learned Advocate for the petitioners seeks leave to withdraw this petition on instructions by keeping the liberty available to take out a comprehensive challenge alongwith a challenge to the impugned order by filing a Regular Civil Appeal, in the event the suit is decided against the petitioners.

Considering the above, this petition is disposed of as withdrawn, with the observation that in the event the RCS No.78/2013 is dismissed, the withdrawal of this petition shall not come in way of a challenge to the impugned order in a Regular Civil Appeal.
