O R D E R

(09th SEPTEMBER, 2023) 1.

The appeal is placed before us in today's National Lok Adalat. Mr. D. G. Kamble, Advocate for the appellants is present. Mr. S. V. Kulkarni, Advocate for the Insurance Company is present. Mr. Jagtap, Advocate for the respondent is present.

The learned advocates for the parties submit that they have amicably settled the lis and accordingly placed on record the compromise terms. The compromise terms are marked as Article ' X' for the purpose of identification.

The appeal is disposed off in terms of compromise terms. 4.

As per the compromise terms the respondent No.2 Insurance Company shall deposit the enhanced amount of compensation of Rs.3,00,000/- in this court within a period of 60 days from the date of receipt of award passed by the National Lok Adalat. 5.

The appellants/original claimants are entitled to withdraw the amount of compensation in terms of modified award and learned concerned MACT shall pass the order to that effect forthwith. 6.

The Chairman/Member concerned Motor Accident Claims Tribunal be informed accordingly.

7.

The court fees refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959. 8.
