IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 2329 OF 2022 Sunil S/o Shravan Bansode Petitioner
Versus
The Union of India & others Respondents Mr. N. J. Patil, Advocate for the petitioner. Mr. B. M. Dhanure, ASG for respondent No. 1.
Mr. S. P. Tiwari, AGP for respondents No. 3 to 4. CORAM : RAVINDRA V. GHUGE & ANIL L. PANSARE, JJ.
DATE : 16th JUNE, 2022.
PER COURT :
1.
This matter was heard for some time. We expressed our disinclination. The petitioner, therefore, sought a pass over. 2.
Respondent No. 6 has addressed a letter dated 16th June, 2022, to the offce of the Government Pleader stating that the representation of the petitioner would be responded to within three months. The same is taken on record and marked 'X' for identifcation.
- 2 - wp2329.22.odt 3.
The learned Advocate for the petitioner submits on instructions that this Court may simply direct the District Collector to consider the representation dated 18th January, 2022, in the light of the communication 'X'.
4.
Since we were of the view that prayer clause 'B' will have to be dealt with by a Civil Court and not under the extra ordinary writ jurisdiction of this Court, this petition is disposed off. 5.
Let the District Collector - respondent No. 5 respond to the representation of the petitioner dated 18th January, 2022, on or before 15th September, 2022. We make it clear that if the response of respondent No. 5 does not redress the grievance of the petitioner in the light of prayer clause 'B' set out in the petition, the petitioner would be at liberty to resort to a proceeding before the Civil Court and not by preferring a writ petition before this Court.
