Applicants seek condonation of delay of 1231 days in setting aside abatement and bringing legal heirs of sole respondent Padminbai Jadhav. The legal heirs have caused appearance in pursuance of the notice issued by this Court. 2.

The cause of action survives as against the legal heirs. They are necessary parties. The delay is unintentional. 3.

Civil application is allowed in terms of prayer clauses "A" and "B".

The amendment shall be carried out within a period of four (4) weeks from today.
