DATE :- 31st July, 2015 Per Court:
(a) Civil Application No.1697/2014 :- Shri Nagarkar, learned Advocate for the Applicants, has taken instructions from his clients in response to the offer put forth by Respondent No.1 as has been recorded in paragraph 2 of the order passed by this Court on 19.06.2015.
Shri Nagarkar submits that his statement, which is on instructions, may be recorded that the Applicants are willing to work
*2* through a contractor with Respondent No.1 till the disposal of this Writ Petition without prejudice to their rights and contentions set out in these proceedings.
Shri Rodge, learned Advocate, has no objection and submits that Respondent No.1 would assist the Applicants in making applications to the contractor so as to be deployed through the contractor as an interim arrangement till the disposal of the Writ Petition. He, therefore, submits that this Civil Application can be disposed of. In the light of the above, this Civil Application is disposed of by permitting the Applicants to approach the concerned contractor with the assistance of Respondent No.1 and seek deployment with Respondent No.1. They shall work with Respondent No.1 through the said contractor till the disposal of this Writ Petition.
Needless to state, this arrangement is arrived at without prejudice to the rights and contentions of all the litigating sides in these proceedings.
(b) Civil Application No.3415/2015 :- The Applicants pray for listing Writ Petition No.6435/2009 for
*3* final hearing out of turn.
Since this Court is taking up old final hearing matters instituted from 1994 onwards on every Thursday, precedence cannot be granted to this Writ Petition. Similarly, an order has been passed today in Civil Application No.1697/2014, which would render some work to the Applicants.
In the light of the above, this Civil Application is rejected. The Applicants are permitted to renew their request after SIX MONTHS. (RAVINDRA V. GHUGE, J.)
