By this petition, the petitioners challenge the order 02.02.2019 passed by learned Chief Judicial Magistrate, Osmanabad, in Criminal M.A. No.675/2016 (new RCC No.147/2019) issuance process against the petitioners/ accused for the offences punishable under Sections 498-A, 323, 504, 506(II) r/w 34 of the Indian Penal Code.

Learned APP submits that the matter before learned Magistrate is fixed for framing of charge.

The instant petition was filed in the year 2020 and it

*2* 919crwp196o20 was never circulated, nor listed on the board. The proceedings before learned Magistrate are initiated in the year 2016. There is no stay granted by this Court. During all these years, substantial development has taken place in the proceedings before the Trial Court and the proceedings have proceeded far ahead and same are kept for framing of charge. Moreover, the petitioners are not at all vigilant and alert in the proceedings. As such, this Court cannot come to their aid, who are sleeping over their rights. In that view of the matter, I am not inclined to entertain this petition.

In view of the above, this Criminal Writ Petition is dismissed. However, in the event, the petitioners are aggrieved by any further order, they are at liberty to take recourse to appropriate proceedings.
