Though learned Counsel for the respondents has opposed for condoning the delay stating that the reasons as are assigned are not sufficient to condone the delay, on perusal of the application, it appears to me that the delay has been sufficiently explained. Therefore, I am inclined to allow the application and pass the following order:-

ORDER

I) The delay of 32 days caused in filing Second Appeal is condoned.

II) Appeal be registered in accordance with law.

III) Civil application stands disposed of.

IV) On registration of Appeal, issue notice to the respondents. Learned counsel Shri Patil (Beedkar) waives service of notice for respondents. Service is complete.

V) List the matter for further consideration on 31.07.2018.
