There is delay of 4542 days and 6177 days in filing the applications for bringing the legal representatives of deceased appellant nos.1 and 2 on record.

Deceased appellant nos.1 and 2 are wife and husband. Proposed legal representatives are their children. Appeal is of

2591.2025CA the year 1994 and at the time of filing appeal, the legal representatives were minors. The matters of the year 1992 onwards are still coming up for final hearing. In that view of the matter, the delay caused in filing the applications for bringing legal representatives of deceased appellant nos.1 and 2 is condoned subject to cost of Rs.5,000/- to be deposited with the Chairman, Library Committee, Advocates Association of Bombay High Court at Aurangabad. The abatement against appellant nos.1 and 2 is set aside and permission is granted to bring their legal representatives on record after deposit of cost.
