Being aggrieved by the compromise decree passed in RCS No.302 of 2020, the petitioner herein has instituted the suit bearing RCS No.417 of 2020. Pending the said suit, the petitioner herein has also fled an application Exh.5 for issuance of the temporary injunction and even by order below exhibit 5 in RCS No.417 of 2020 dated 11.11.2020 trial court has issued notice to the defendants.

It appears that the petitioner has fled present writ petition again challenging the same compromise decree aaa/-

WP 2510.2021..odt passed in RCS No.302 of 2020. The same is unwanted and uncalled for. There is no reason to entertain this writ petition.

At this stage, the learned counsel appearing for the petitioner, on instructions, seeks leave to withdraw this writ petition. Leave granted. Writ Petition is disposed off as withdrawn.
