1] Heard.

2] Learned counsel for the appellant submits that appeal raises challenged to the order passed under Section 140 of the Motor Vehicles Act. It is submitted that during pendency of appeal, the main petition i.e.

claim application filed under Section 166 of the MV Act has been decided on merits and appeal is also filed against the said judgment and award.

3] In view of the disposal of claim application on merits, no cause survives to prosecute the appeal preferred challenging

930.18FA.odt the order passed u/s.140 of M.V.Act. Hence the appeal is disposed of as infructuous.

4] The amount, if any, deposited including statutory deposit be transferred as deposit made in MACP No.42/2012.

5] Appeal is disposed of in above terms.
