Para No. 4 of the affidavit in reply filed by respondent Nos. 2 to 7 reads thus :

"4.

I say that, in the Beed district, at about 1265 villages have been selected for implementation of the said scheme and as on today, 1192 work orders have been issued in favour of the lowest bidders by floating the tenders and they have started the works as per guidelines and the project reports. There is heavy burden upon the officers of the respondent No. 2 for implementing the scheme of Jaljeevan Mission, therefore, inadvertently, the mail sent by the petitioner had not been seen and he declared disqualified."

In view of the above, the claim put forth by the petitioner that his tender offer was illegally rejected appears to be justified.

In view thereof, we direct the respondent Nos. 2 to 7 to proceed ahead with the tender process by considering the tender of the petitioner to be validly submitted. The writ petition is accordingly disposed of.
