The learned counsel for the petitioner submits that the petitioner has given notice/application as per clause 15 (2) of the tender for settlement of claim and short closing the tender to the respondent No. 2 (page no. 166). The learned counsel submits that as per the tender, the respondent No. 2 is competent to take decision on it. 2.

The learned A.G.P. accepts notice for respondent No. 2. 3.

In case, the respondent No. 2 is competent to take decision as per

2 929-wp 2031-2022.odt clause 15 (2) of the accepted tender for settlement of claim and short closing the tender and the petitioner has made application (page no. 166) and the same is pending with respondent No. 2, then the respondent No. 2 shall take decision upon it on its own merits, in accordance with law and procedure, expeditiously and preferably within a period of six (06) months from today. 4.

Writ petition is disposed of. No costs.
