The petitioner had applied for grant of centre for conducting S.S.C. Examination. The said request is rejected by the respondent No. 5. Aggrieved thereby the present petition. 2.

The learned counsel for the petitioner submits that, the petitioner school has 25 rooms. It has two storied building. There are infrastructural facilities available. The old centre at Zilla Parishad school does not have infrastructural facilities. The same is also recommended by the Centre Head and the

2 wp 1962.17 Education Extension Officer. The learned counsel submits that, only on the ground that strength of students is less the request is rejected. The same is not sufficient. Infrastructural facilities ought to have been considered.

Mrs. Rasal, the learned counsel for the respondent No. 5 supports the order and submits that, already old examination centre is existing in the said village. If the petitioner is given centre, the same would affect the existing centre. Even the students are less.

We have considered the submissions canvassed by the learned counsel for respective parties.

The petitioner is seeking a new centre for S.S.C. examination. In the same village there are four schools and in Zilla Parishad school the S.S.C. centre exists since many years. Considering the reasons given by the respondent No. 5/board, it is not appropriate for us to entertain the petition. However, the petitioner may apply afresh for the next year, which application would be considered by the respondent No. 5/board on its own merits. The writ petition accordingly is disposed of.
