1] Since an appeal presented by the State Government being Criminal Appeal No.146/2016 is already admitted by this Court as against the original accused nos.1 to 4, the purpose of presenting the instant appeal is served. The Division Bench of this Court while dealing with the State appeal has refused to grant leave as against the accused nos.5, 6 and 7.

2] Since the Division Bench of this Court has already applied its mind to the case and refused to grant leave

Cr.Appeal 65/16 - 2 - as against the accused nos.5, 6 and 7, the decision cannot be interfered with while considering the appeal by the original complainant. The purpose of presenting the instant appeal is served since the State has already presented the appeal. The instant appeal as such stands disposed of.
