IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO.3131 OF 2021 IN WRIT PETITION NO.1878 OF 2019 (Nathuji Shankarrao Bhakre Vs. The Chief Executive Officer) WITH WRIT PETITION NO.1878 OF 2019 (The Chief Executive Officer, Parbhani District Central Co-op. Bank Vs. Nathuji Shankarrao Bhakre) ---- Mr. Shivraj B. Kadu, Advocate for the applicant Mr. S.G. Joshi, Advocate for the writ petitioner ---- CORAM : MANGESH S. PATIL, J.

DATE :

24.08.2021 PER COURT :

Heard.

2.

The applicant is the respondent in the Writ Petition, who has been complaining about the petitioner in the Writ Petition having practised unfair labour practice by not paying subsistence allowance. By way of this application, he has prayed to direct the original petitioner to produce his service related documents, including the service-book and the calculation of subsistence allowance.

3.

The petitioner bank has opposed the request and submitted that according to the calculations, the respondent (present applicant) has

CA3131-2021 been paid subsistence allowance and the balance amount of Rs.15,250/- has already been deposited pursuant to the interim order passed by this Court. 4.

The entitlement of the respondent-employee to get subsistence allowance is a matter in dispute and obviously, the record possessed by the petitioner bank would make the picture clear. 5.

The Civil Application is allowed in terms of prayer clause (B). The petitioner bank shall produce the documents on or before the next date. 6.

The Writ Petition is adjourned to 22.09.2021. Interim relief to continue till the next date.
