According to the applicants, the appellant No. 2 has died on 14th December 2014, at Tambala Tq. Nilanga, Dist. Latur, leaving behind him the legal heirs applicant No. 2A to 2H, as stated in para 1 of the present application. The present application is filed by the applicant on 9th February 2015. The period of limitation prescribed under the law is of 90 days for bringing the legal heirs of deceased. The Death Certificate of deceased appellant No. 2 Sidram Shankarappa Hatte, is filed on record. On perusal of the xerox copy of Death Certificate, it appears that the appellant No. 2 Sidram Shankarappa Hatte, has died on 14 December hawca2524.15
2014. There is no contest to this application. The present application is well in time. Therefore, I find no difficulty to allow this application and to pass following order.
The civil Application is hereby allowed.
The applicants are permitted to bring on record the legal heirs of deceased appellant No. 2 within the period of 14 days from the date of this order.
The necessary amendment be carried out in the cause title of the appeal memo.
Accordingly civil application stands disposed of.
