The petitioner has come to this Court challenging non-approval of the petitioner to the post of 'Shikshan Sevak'. 2.

It is the case of the petitioner that he was appointed as a Shikshan Sevak by following due process of law. His proposal was duly sent by Respondent No.4-School Management to Respondent No.2Education Officer, Primary, Zilla Parishad, Nanded, however, the said proposal came to be rejected by the authority. 3.

This Court has seen the impugned order which states that with the said proposal there is no copy of the advertisement published in the newspaper, no list of candidates called for interview and no any chart is Narwade/

969.odt prepared and produced, and also there is no prior permission obtained from the office of Respondent No.2. It is on these grounds, the proposal is rejected.

The petitioner has challenged the said communication. Even today there is no such advertisement placed on record with the copy of newspaper. If that is the only reason for non-approval, this Court find it appropriate to direct the Management to submit a fresh proposal along with newspaper advertisement etc. If such proposal is submitted, Respondent No.2 to consider the same within eight weeks thereafter, in accordance with law.

In view of the above direction, impugned order is quashed and set aside.
