Learned counsel for the petitioner submits that the petitioner is a Voter. The post of Sarpanch of Grampanchayat Chinchale is reserved for ST (women). There is no ST candidate available. There is no ST (women) elected as a Member of the Grampanchayat.

Learned AGP submits that in that case, Rule 4-A of the Bombay Village Panchayat (Sarpanch and Up-sarpanch) Election Rules, 1964 would be adhered to.

In view of the said statement, writ petition is disposed of. No costs.
