Learned counsel for the petitioners, on instructions, submits that the petitioner wishes to withdraw the petition. However, considering the fact that the petitioners No. 2 to 4 are from Pune and Bangalore and that petitioner No. 2 Bharti is presently undergoing knee surgery, exemption from their personal appearance before the learned Judicial Magistrate First Class may be granted.

Accordingly, the criminal writ petition is allowed to be withdrawn. Further, considering the fact that the petitioner No. 2 is undergoing knee surgery presently and that the petitioners No. 2 to 4 are from
criwp180-2016 Pune and Bangalore, the learned Judicial Magistrate First Class is requested not to insist for framing of the charge on the next date and in case any application for permanent exemption of petitioners No. 2 to 4 from personal appearance is filed, the same shall be decided sympathetically.
