Heard learned Counsel for the petitioner and respondent, perused the impugned order.

On due consideration of submissions advanced in the light of order passed by the trial Court, I am of the view that no case is made out to invoke the writ jurisdiction under Article 227 of the Constitution of India to interfere with the order passed by the trial Court. The suit came to be

3397.18wp filed in the year, 2006. The issues were framed on 22.9.2014. The application (Exh.69) came to be filed on 7.8.2017 i.e. after a period of about three years of framing the issues. The suit is already matured for final disposal and listed for evidence. In this view, Issue No.5 can be decided along with other issues. I am, therefore, not inclined to interfere with the order impugned. Petition is dismissed.
