IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.2090 OF 2022 RAVIKANT SHIVAJI NARHARE ..PETITIONER

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ..RESPONDENTS ...

Mr. V. D. Gunale, Advocate for the Petitioner. Mr. A. S. Shinde, AGP for Respondents-State.

...

CORAM : S. V. GANGAPURWALA & S. G. DIGE, JJ.

DATED : 14th FEBRUARY, 2022.

PER COURT:- 1.

We have heard learned counsel for the petitioner.

2.

The petitioner seeks directions to refer the dispute about the apportionment of the amount of compensation to the Civil Court.

3.

The order dated 21.12.2021 passed by the Competent Authority suggests that, the matter would be referred to the Civil Court, as the dispute of ownership appears from the record.

4.

As the Competent Authority itself has passed the order to refer the dispute to the Civil Court, no further orders are required by this Court. In fact, the prayer in the petition is misconceived.

(2) 27-wp-2090-2022 5.

The Authorities may take further steps in tune with the order passed expeditiously, on its own merits, in case there is no other impediment. 6.

Writ Petition is disposed of. No costs.

(S. G. DIGE) (S. V. GANGAPURWALA) JUDGE JUDGE Devendra/February-2022
