The reading of the reasons forwarded by the learned Judicial Magistrate First Class in the impugned order would show that an arguable case is made out as to whether the benefit of the exceptions to the provisions of section 499 of the Indian Penal code could have been extended in the case as in the criminal complaint filed by the respondent against the present applicant - Advocate, she remained absent.

In the circumstances, leave to file appeal is hereby granted. The appeal be registered as per the due procedure of law.
