This Court has passed the following order on dated 6.8.2025 :- "1.

The present petition arises out of orders passed below 'Exhibit 52' and 'Exhibit 61' in Misc. Application No. 11 of 2020, which was earlier filed before the Court of learned Civil Judge Senior Division, Rahata. The proceeding is ordered to be transferred to the Court of Civil Judge Senior Division, Thane vide order dated 28.02.2025 passed in Misc. Civil Application No. 176 of 2024. 2.

In view of the above, the petition be placed before the learned Registrar (Judicial) in order to decide as to whether the petition will lie with this Bench or before the Principal Seat at Mumbai."

Thereafter matter was placed before the Registrar Judicial. Today submission of Registrar Judicial is placed before this Court in which it is submitted that the present writ petition would lie before the Principal Seat at Mumbai and not before this Court.

By way of present writ petition, the petitioner challenges the orders arising out of Misc. C.A. No, 11/2020. The said proceedings pending before the learned Civil Judge, Senior Division, Rahata are transferred to Civil Judge, Senior Division, Thane. Since the main proceedings are before the Civil Judge, Senior Division, Thane, the present writ petition would not be entertained before this bench. 4.

In view of the above, the learned counsel for the petitioner seeks leave of this

WP 2109/2024 Court to dispose of the present writ petition with liberty to file the same before the Principal Seat of the High Court. Considering the same, the writ petition is disposed of as not entertained before this bench and with liberty as prayed for. ( ARUN R. PEDNEKER, J. ) ssc/
