Applicants seek restoration of second appeal, which has been dismissed in default vide order dated 18.3.2024. It appears that because of consistent default in appearance before the court, the order impugned is passed. Learned advocate for applicant explains his absence in para.2 of the application.

Considering reasons stated in the application, same deserves to be allowed by condoning delay of 293 days caused in filing application, however, subject to costs of Rs. 3,000/- to be deposited with the High Court Bar Library, within four weeks. On deposit of costs, appeal be restored to its original position.
