The petitioners have an efficacious statutory remedy against the order dated 09.11.2023 passed by the Planning authority-cum-Chief Officer, Municipal Council, Nilanga.

After a short hearing in this matter, we do find that there are several disputed issues. When a statutory remedy is available with such issues involved, we do not approve that a Writ Petition would be a remedy.

In view of the above, we grant liberty to the Petitioner to avail of the statutory remedy as is permissible in law. 4.

The Writ Petition is disposed off.
