Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The first informant and the applicant are the brother. The first informant had lodged the report making allegations that the applicant had assaulted him with an axe on head and neck. The applicant was arrested. The weapons allegedly used in the crime were recovered. However, the first informant/ injured had filed an affidavit before the Sessions Court stating therein that in the hit of anger, he had given the statement before the police against the applicant. However, he did not assaulted him. They have settled their misunderstanding and dispute. The first informant/injured voluntarily filed affidavit
934-BA.274-23.odt to that effect. The injured has been discharged from hospital. He has no danger to his life. The applicant is 19 years old student. There are no antecedents to his discredit. In view of the facts, subsequent developments in the case and considering the age of the applicant, he deserves bail. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant KRUSHNA ASHOK TAK be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.486 of 2022, registered by Police Station Selu, District Parbhani, for the offences punishable under Sections 307, 324, 504, 506 read with Section 34 of the IPC, on the condition not to tamper with the prosecution witnesses.
