Upon production of the copy of the report received from the Investigating Officer, the same is taken on record and marked as "X" for the purpose of identification.

Learned counsel for the applicant submits that the applicant does not wish to press the application for release on bail on merit of the case, however, finding that 35 years old applicant is suffering from Cold Abscess Lt. Pleural effusion. He has already undergone certain surgery. Therefore, he may be released on temporary bail.

On the other hand, learned A.P.P. submits that the report would show that the applicant is already admitted to Civil Hospital, Dhule and the treatment is being carried.

Learned counsel for the applicant however replies that since the complications are there, it may be viable to have the treatment in a private hospital. 6.
Upon hearing both sides and considering all the facts on record, even temporary bail cannot be granted to the applicant. However, as and when suitable the authorities may, on the advice of the expert, get the present applicant admitted in the private hospital of his choice at his cost of keeping
3 Cr. Appln. 912/2016 the guards or of allowing private medical expert in the civil hospital.

With these directions, the application stands disposed of.
