IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.2219 OF 2018 (Vaijapur Merchant Co-operative Bank Ltd., Vaijapur Vs. The Divisional Joint Registrar and others) Mr.L.H.Kawale h/f Mr.K.J.Suryawanshi, Advocate for the petitioner. Mr.S.K.Tambe, AGP for respondent Nos. 1 and 2. ( CORAM : RAVINDRA V. GHUGE, J.) DATE : 27/02/2018 PER COURT :

1.

I have heard the learned Advocate for the petitioner in extenso. He has strenuously criticized the impugned order dated 03/02/2018. 2.

Notwithstanding the above, the issues before the Divisional Joint Registrar in proceedings u/s 154 of the M.C.S.Act are with regard to whether a reasonable opportunity was granted to respondent Nos. 3 and 4 by respondent No.2 in the Section 101 proceedings. It is informed that the petitioner as well as respondent Nos. 3 and 4 have completed their submissions in revision Application No.6/2018 filed by respondent Nos. 3 and 4. 3.

Learned AGP appears on behalf of respondent Nos. 1 and 2 submits that since a very short issue is involved, respondent No.1 khs/FEB.2018/2219-d

would not take much time to decide the revision. 4.

Considering the above, this petition is disposed of with a direction to respondent No.1 to decide Revision Appl.No.6/2018, as expeditiously as possible and in any case on or before 28/03/2018, since it is informed that the oral submissions of the litigating sides have concluded.
