Heard learned counsel for applicants-original claimants no. 3 and 4 in land acquisition reference before reference court and learned Assistant Government Pleader for respondent no. 2 - State. 2.
There is no dispute over that the first appeal filed by acquiring body against award by land acquisition reference court has been dismissed. Initially claimants are stated to have been allowed to withdraw seventy five per cent of the amount deposited on furnishing bank guarantee of nationalized bank and rest of the amount was directed to be invested in fixed deposit receipts till decision in the first appeal.

In view of aforesaid, while there is no dispute that first appeal has been dismissed, it would be expedient to allow applicants to withdraw, to the extent of their share as prayed for, from remaining amount lying deposited by acquiring body in this court in respect of land acquisition reference award passed for compensation towards acquisition of land of applicants. 4.
Having regard to above, applicants are at liberty to withdraw their share in balance amount of compensation lying deposited in this court with interest accrued thereon.

Civil application is disposed of.
