The Application is filed for condonation of delay of 54 days in filing the application for restoration of Letters Patent Appeal and also for recalling the order of dismissal of Letters Patent Appeal on default, on non-prosecution ground.

In view of the nature of dispute and the contentions made in the Application, this Court holds that there is sufficient cause shown. The Counsel has taken the blame on himself for remaining absent. So, the Application for condonation of delay is allowed. The delay is condoned. The prayer for restoration of LPA is also allowed. The order of dismissal is recalled and the matter is restored. 4.

List the Letters Patent Appeal for final hearing on 16.03.2018.
