1) The application is filed for condonation of delay of 271 days caused in filing appeal against the judgment and award of Claim Petition No.93 of 2010 which was pending before the Claims Tribunal, Ahmednagar. Both the sides are heard.

2) In view of the contentions made in the application and the submission made this Court holds that sufficient cause is shown. Learned counsel for the

2 CA 2747 of 2015 respondents has strong objection and he submits that in execution proceeding some amount was accepted by the claimant towards full and final settlement. This contention can be considered in the appeal itself. So the application is allowed. Delay is condoned. Notice in appeal, it is waived by learned counsel for the respondents.
