Mr. Patil, the learned counsel submits that, the state has submitted B summary report before the Judicial Magistrate First Class. However, as the stay is operating in the present application the orders are not passed.

Considering the above, we dispose of the present criminal application. The Judicial Magistrate First Class, Chalisgaon, shall pass appropriate orders in R. C. C. No. 390 of 2011 in accordance with law and on its own merits, pursuant to the B summary report received by it expeditiously and preferably within three (3) months from today.
