After having heard learned counsel for the applicant, learned A.P.P. and learned counsel for the intervenor/informant, this Court finds it to be a fit case to suspend execution of substantive sentence of imprisonment. The applicant has been convicted for the offence punishable under Section 307 of the Indian Penal Code and therefore, sentenced to suffer rigorous imprisonment for five years. He has been in jail for little over one year. 2.
The fine amount has been deposited. Considering the quantum of sentence and the fact that the appeal is not likely to come up for final hearing in near future, the execution of substantive sentence of 1 / 2

The applicant be released on his executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. He shall not enter Madane Wasti, Wangdari, Tq. Shrigonda, Dist. Ahmednagar for next two years. He shall mark attendance at the concerned police station once a month i.e. on first day of each month between 10:00 a.m. to 12:00 noon, till conclusion of appeal..
