Heard both the sides.

Considering the challenge made to the judgment and award passed by the Reference Court and the fact that Section 4 notification was published in the year 1995 and till this date, the Applicants have not received the compensation at the enhanced rate for their acquired lands though they are entitled, the Applicants are permitted to withdraw 60% of the amount deposited before this Court on certain conditions.

The Applicants are permitted to withdraw 40% of the amount on furnishing undertaking and 20% of the amount on furnishing solvent

931 ca.3351.17 ors.odt surety to the satisfaction of the Registrar (Judicial) of this Court. The remaining amount of 40% shall be invested in any nationalized bank till further directions of this Court.
