2024:BHC-AUG:2819 {1} 909-APPLN-623-2024
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD CRIMINAL APPLICATION NO. 623 OF 2024 IN APEALST/1594/2024 Vishal Achutrao Umap ....Applicant
VERSUS
The State Of Maharashtra And Another .....Respondents .....
Mr. A.L. Kanade, Advocate for applicant.
Mr. N.B. Patil, APP for respondent No. 1.
.......
[CORAM : NITIN B. SURYAWANSHI, J.] DATE : 9 th FEBRUARY, 2024 ORDER :
1.
This application is filed seeking condonation of delay of 2024 days in filing criminal appeal for cancellation of bail of respondent No. 2. By order dated 04.08.2018, respondent No. 2 was granted bail by learned Additional Sessions Judge, Beed. 2.
Learned advocate for applicant contends that the 2nd respondent has flouted condition No. 3 by which he was directed not to influence and/or contact witnesses of prosecution. Further submission is that 2nd respondent has moved an application to the Chief Executive Officer, Zilla Parishad complaining that applicant has falsely obtained benefit of Ramai Gharkul Yojna, Bhagyawant Punde
{2} 909-APPLN-623-2024 though he was not eligible for the same. According to applicant this is violation of condition No. 3 imposed on respondent No. 2. 3.
There is no merit in the contention of applicant that respondent has flouted condition imposed by learned Additional Sessions Judge while granting bail. Delay is not properly explained by applicant and even on merits applicant has no case. Application for condonation of delay is therefore rejected. [NITIN B. SURYAWANSHI, J.] Bhagyawant Punde
