None present for the LR's of Respondent No.3 in spite of service of notice. Absence of the this Respondent indicates that he is not interested to oppose the Application.

Perusal of the Application indicates that the Petitioner had no knowledge about the death of Respondent No.3 until the service report indicated so. Thus, it cannot be said that there are any malafides in not making Application in time. No prejudice will cause to the LR's of deceased Respondent No.3 were brought on record. 3.

Hence, Application stands allowed in terms of prayer clauses 'B' to 'D'. Amendment to be carried out within a period of two weeks. If amendment is carried out, issue notice to the added Respondents, returnable on 27th November, 2025.
