The learned counsel for the petitioner submits that the present petitioner is similarly situated as that of the petitioner in Writ Petition No.12057/2018 decided on 24.09.2019 and is also claiming the same relief.

The learned counsel further submits that the Writ Petition No.12057/2018 has been disposed of on the basis of the contents of the affidavit filed by the Block Development Officer, Panchayat Samiti, Pachora. The learned counsel submits that the present petition may also be disposed of on the basis of the order dated 24.09.2019 passed in Writ Petition No.12057/2018.

In view of the order dated 24.09.2019 passed by this Court in Writ Petition No.12057/2018 and the fact that the present petition is also relates only to the extent of recovery of increment, the present writ petition is disposed of.

Respondents accepted that recovery would not be made from the petitioner for the increment. 5.

If some amount is already recovered by the respondents the same be returned to the petitioner within a period of four months.

Writ petition is disposed of. No costs.
