We have heard Mr. Godhamgaonkar, learned Counsel for the petitioner, the learned A.G.P. and Mr. Kadethankar, learned Counsel for the respondents.

It is submitted by the respondents that the petitioner has a remedy of Election Petition. 3.

The petitioner is challenging the declaration of respondent no. 5 as an elected candidate. The

2 wp 2577.2021 same can be challenged by way of an Election Petition.

In view of that, writ petition is disposed of with liberty to the petitioner to avail the alternate remedy. All contentions are kept open. 5.

In view of disposal of the writ petition, the civil application stands disposed of.
