Learned advocate for the petitioner submits that though he has challenged the order passed by Hon'ble Minister whereby his CL-3 licence was suspended, during the pendency of the dispute, State Government has issued licence in his favour, rendering writ petition infructuous.

This Court vide order dated 03.03.2006 directed the petitioner to deposit amount of Rs. 10,000/-, which he had deposited and subsequently by order dated 20.09.2006, this Court had directed the petitioner to deposit 50% of the profits at the end of each quarter until final decision of the civil dispute or till final order of this Court.

Learned advocate for the petitioner submits that accordingly he had deposited amount of Rs. 10,000/-, 4,622/-, 6256.50/-, 4,927/- and 4,500/-, 4,621.50 Ps. And 5,124/- which totals to Rs. 40,051/-. He has also placed on record receipts of deposit of aforesaid amount.

In view of final decision in favour of the petitioner by State Government granting him licence, nothing survives in this petition. Therefore, learned advocate for the petitioner seeks withdrawal of the petition.

In view of above, writ petition is disposed of as withdrawn.

As a result amount of Rs. 40,051/- alongwith interest accrued on the respective amounts deposited by the petitioner as per the direction given by this Court, is permitted to be withdrawn.
