Mr. Bondar the learned counsel for the petitioner submits that the petitioner is a defeated candidate. The post of Sarpanch of Grampanchayat Jodpimpri is reserved for ST category. However, no ST candidate is elected as a Member of said Grampanchayat. 2.

The learned AGP submits that in that case, Rule 4-A of the Bombay Village Panchayat (Sarpanch and Up-sarpanch) Election Rules, 1964 would be adhered to.

In view of the said statement, writ petition is disposed of. No costs.
