ORDER:

It is submitted that the validation proceeding in respect of the tribe claim of the petitioner is pending since the year 2016. Same is not yet decided. The employer has issued notice to petitioner to submit the validity within one month or else the services would be terminated.

The learned counsel for the petitioner states that, the vigilance is not yet conducted.

The Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner expeditiously, preferably

2 Sr911 WP1700.2018 within a period of six months from today. The petitioner shall cooperate in expeditious disposal of the proceedings. The petitioner shall appear before the Committee on 28.02.2018. 4.

The respondent-employer shall not take coercive action against the petitioner only on the ground that the validation proceedings are pending. The respondent-employer may take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceedings. 5.
